We're Here to Help You Fight For Child Support

Nashville Child Support Attorney

Compassionate Representation for Family Law Matters

Whether you are going through a divorce, or are an unwed parent struggling to make ends meet, child support can make all the difference. At Martin Sir & Associates, we want to help you ensure that your children have the best chance at a comfortable lifestyle by fighting for the child support order that you need.

Both parents are legally obligated to financially support their children after a divorce, regardless of custody and visitation arrangements. Child support payments are determined based on the income level and resources of each parent, the amount of time that the child spends with each parent, and any unique needs the child might have associated with their care.

Attorney Martin Sir was granted Avvo’s Client’s Choice Award in 2012 and 2014, which is a testament to his commitment to providing personalized customer service to each of his clients. Our firm has been recognized by our peers and by those who have worked with us for our standards of professionalism. Let us put our experience to work for your family.

How Courts Determine Child Support in Nashville

The court may require that the higher-earning or non-custodial spouse pay child support in order to fulfill his or her duties as a providing parent. Because higher income typically means higher child support payments, non-custodial parents may attempt to purposely lower their income to avoid paying higher amounts of child support. In this case, courts may impute income from a parent who is below their earning capacity in order to ensure that they are fairly fulfilling their obligation of care to their child.

To calculate child support, the court will look at:

  • The financial needs of the child
  • The child's standard of living prior to divorce
  • The age and health of the child
  • The monetary and non-monetary contributions of each parent to the well-being of the child
  • Pension or retirement benefits from each parent
  • Education needs of the child
  • The earning capacity of each parent
  • If the non-custodial parent's visitation is more than 110 days per year or less than 55 days per year

A parent may also be required to provide insurance coverage for the child if he or she can receive such coverage through work.
